if i understand the logic - at least if applies to United States Law fan subs are fair use ONLY if the content is not licensed for distribution than one can re-subtitle a cartoon and give it away for free. As long you don't make any money you can make fan subs under the derivative work clause.

It still seems weird to me. Taking someone else's product, putting subtitles on it, and then distributing it. Seems like the original creator ought to retain the rights to the product such that they can say "No, you cannot subtitle this."
